I found out today that I will be reassessed in December 2014. That means only awarded for 8 months,so will have to go through the process again. Can I appeal to have a longer reassessment period,or just leave well alone?

Did you gain confirmation of the prognosis from ringing the DWP number ?

There are no 8 months prognoses, they are 3, 6, 9, 12, 18 and 24 months, or "In the longer term" which generally equates to 2 or 3 years, which is the maximum.

It is highly likely that if your reassessment is due to start in December 2014, that this is a 12 months prognosis, as they tend to initiate reassessments 2-3 months before the end of a prognosis period to allow for the administration of the reassessment process.

You cannot appeal this, as the prognosis does not form a part of the SG award in law.

It is purely a recommendation.

Legally, you can be reassessed 3 months after any ESA award.

Your ESA payments would not cease if you did not receive an ESA50 for reassessment in December. Payment would continue as is, until you have undergone the reassessment and a fresh decision has been made.

I phoned today and asked when I would be reassessed, the operator said "Oh yes,yours is a short period and will be looked at again in December 2014"

The reason I said 8 months,is ESA has only been awarded from this week.

Hi P,

The December date is likely to be the date flagged up to start the reassessment process.

As previously stated, they start the reassessment 2-3 months before the end of the prognosis period.

They have to allow for ATOS posting out the ESA50, the 4 weeks that you will then have to fill it in and return it, and then the time taken for ATOS to carry out a reassessment. (with or without a F2F)

ATOS would then make their recommendations in the form of a medical report, return it to The DWP, who would then make the decision and inform you in writing.

All this can take several months.

You could make a request for the documentation used in coming to the decision, see this post for further information :

It is still rather a short prognosis for The SG. As your M.P. has been involved, you may wish to query the reasons for this with them, taking into account my previous comments regarding you not being able to challenge it legally.

Eventually got ESA 85A along with a copy and paste letter from DWP to my MP. I am going to be reviewed in 12 months.

I noted that they used Form Med 3,a form I have I have not submitted for several years. ESA 85A completed the same day as ESA 50 received, very efficient.

ESA went into payment in Feb.2014,so, I think I will have to go through all this again in Oct 14.

DWP often mention the Med3 form, even when the claimant has not submitted one of these for many years. We suspect that this appears automatically on the letters and whoever initiates them does not delete it.

Hi everyone
I requested a copy of all evidence used in my case. I received it ,but on the covering letter it stated

"The medical assessment report ESA 85A has been prepared for state benefit purposes only and may only apply for a limited period"

Is this incase anyone tries to use this report for anything else.?
