bobby wrote: just plucked up courage to contact dwp. Apparently they received descision notification from tribunal on 18/3/15.There is nothing else on file but lady stated 4-6 weeks for them to decide if they were going to appeal to upper tribunal. She suggested I phone back at the end of month.I did ask whether it was 4/5/or 6 weeks but she was unable to give definitive date. She did say she would forward an email to them - unsure whether good/bad move. Will wait to see ---again!!
Hi b,
The rules for seeking leave to appeal to The UTT are exactly the same for the DWP as they are for the appellant. (You)
They have one month from the date of the decision notice (Not the date that they receive it) to request a : Written Statement of Reasons from The TS.
Once they have that, they then have a further month from the date of The Statement of Reasons (S of R) letter to seek leave to appeal to The UTT.
You would know, if they had requested an S of R, as you would also be sent a copy.
If they don't request the S of R within the one month deadline this may preclude them from seeking leave to appeal to The UTT at all.
They cannot simply seek leave to appeal because they do not agree with the decision, they must prove that The Tribunal have "erred in law" when coming to the decision :
What is an Error of Law?
