new medical condition since assesment

since having a medical assessment on the 14/8/2012 i made an appeal to go to a tribunal about my score because i believe it was unfair and not given a correct appraisel.i have since developed a hip impingement and also osteoarthritis in both hips which limits my movements even more severely, and am waiting to see a specialist about an operation.and was wondering does this count towards the existing appeal

To answer your question. Unless you have clear medical evidence that you were suffering from the effects of these new conditions at the time of your assessment then they will be excluded.

You do not say what you are appealing; a Fit for Work Decision or a WRAG placement?

If the former, then you may be able to make a new claim for ESA based on a new or deteriorated condition.

If the latter then you may be able to request a re-assessment of your claim because of the change in your conditions.
