Statement of Reasons was created by summertrain
I was awarded ESA Support Group recently thanks to the wonderful guides here at B&W.
I rang to request the copies of the documents shortly afterwards, but as yet have received nothing.
I have today used your template letter to request this in writing, as it has been over a month since my request.
How long do the DWP reckon to take sending these documents?
I understand there is a 40 day requirement to comply with a request under the Data Protection Act.

Hi Summertrain,

The DWP take varying amounts of time to comply with this request. Some people seem to get the paperwork very promptly, others have to make repeated requests.

Once a SAR is made, DWP have 40 days in which to respond. We have members who still have not received the requested paperwork in the specified time and have had to take the matter to the Data Commissioners.

I still have had no reply to this request after well over 40 days, and so I have sent a written request for the documents used on the decision for my ESA award in May.

What should be the next step if the DWP do not comply with this renewed request? Should I give them a further 40 days or should I take it further?

Hi st,

A letter containing a threat to complain to The ICO generally does the trick.

As they have exceeded the 40 days allowed, you could send this now.

It may also be worthwhile, including a copy of your original SAR with it.

You should address it, FAO The Data Controller at the benefits office dealing with your ESA. Write DPA 1998 SAR in front top left corner of the envelope.
