I think that, in your situation, I would be bringing this to the attention of my MP
Contacting your MP
MPs cannot interefer with the decision but s/he might be able to get things moving for you. At worst, s/he would be aware of how long people are having to wait!

Well after yet another cancelled appointment by Atos and a six month wait the brown envelope has come and the result is 0 points ! I felt physically ill after i opened it, after i had calmed down and got myself together i have decided that the way to go is like others in my situation to Appeal. Have already sent my GL24 off by recorded next day , and requested the necessary docs from them . They have already stopped my benefit from the 24th May, so it will hit hard next week, i cannot see my doctor until the 7th june, so will my med 3 need to be backdated to 24th May ? Many thanks for your help, dont know where i would be without your excellent guides.

Yes, you will need a Fit Note issued from the 24th, it usually takes 10-14 days from when they receive the Fit Note for payment of the Assessment rate to start.

Hi a Q my husband is retired and receives a Pension , does this get considered if i was to apply for income related esa ?

Any claim for ESA(IR) would have to be made as a couple, so your husband's pension will be taken into account in deciding whether you are entitled to ESA(IR).

Hi again an update i sent in appeal form and the decision was looked at again so it was looked at twice and the 2nd decision was awarded 6 points , again still appealing and then i was sent all the necessary paperwork etc to go to tribunal. Heard from tribunal and asked did i still want to do this so sent back form ticked yes. Week later was sent another letter stating looked at the decision again , 3rd time and this time it was changed in my favour and would not now need to go to tribunal, few days later my money backdated to may was paid into my bank, then another letter came stating that my appeal has been heard by an independent appeal tribunal ! and the tribunal has decided that i am entitled to ESA , which upon looking through the paperwork i noted that i was in the support group. Thought the tribunal bit was strange as i had asked for an oral hearing so was getting everything i could to supprt that as i was also told that not to ask for a date for this until 6 months time. Well obviously i am pleased at the outcome of this and i would like to say thank you to you all on here, as without your guides i would not have known what to do and give me the confidence to keep going.
