macker wrote: Hi thanks for your comments and advice. The appeal was heard today and was allowed and I am now in the ESA Support group backed to May 2012. It was passed because I said I fitted descriptors 1.1.and 1.2 on the physical side which the Tribunal agreed with.Yippee!!!!
Congratulations on the result.
You may be able to speed any back payments that are due by sending the DWP, ideally by fax, a copy of the Decision Notice from your appeal.

by December 2013 I had received a sum into my bank account but no breakdown as to what it represented.I queried this but to no avail till finally on the 23 rd of January 2014 I was told I was still in the WRAG and had been placed in that by a decision taken on 20/6/2013 and effective from 1/8/2013 .I was never informed of this decision which stemmed from a medical on the 17/4/2013.
I was advised by the chap who rang me to appeal again and he has sent me a form to do so.What a waste of time and money!

Going back through your posts, the Tribunal you recently won to be placed in the Support Group, was for a Decision in 2012, this latest Decision (01/08/13) places you back in the WRAG.
It is appealable in the same way as before, you are not required to request a Mandatory Reconsideration.
If you need any help with this, please reply to this post.

"It is appeal able in the same way as before, you are not required to request a Mandatory Reconsideration."
I received the appeal form and sent it off saying I was appealing, the DWP replied 13/2/2014 and said "we will look again at the decision and if appropriate , we will revise it" they went on to ask if I had further evidence which supported my appeal , to send it to them.IS THIS A MANDATORY RECONSIDERATION????ShouldI query this ?
