The Government have stated the IB claimants will be moved onto ESA(CB), this is not affected by whether you are receiving the Assessment rate or not.

But If you 'fail' your medical that means putting in anew claim doesn't it? And that will be means tested as the old linking rules have gone? Have I got that right?

No you are appealing the decision from your first claim.

If you were to submit a subsequent claim, either due to a deterioration of your condition or after six months had elapsed, then this would be a new claim. Whether you received ESA(CB) or not would be dependant on how the DWP viewed your NI contributions in preceeding years.

Oh I think I see. Thank you. :)

So when I fail my medical (lets face it the default for ATOS seems to be you're 'cured' for nearly everyone) and I put in an appeal and ask to be paid at the assessment rate that will be contributions rated esa and so having that house means I can still be paid as I'm not renting it out (I'm in the process of inheriting it) and so It'll be like what I'm receiving now only less money, ie not means tested.

Call me a pessimist but 'how' and should' don't always tie up when it comes to the crunch. ;)

Sorry to keep going around in circles but I just needed some conformation as I thought you see that whenasking for the assessment rate whilst appealing was seen as a new claim and as I hadn't been working the past 6 years (of course) I wouldn't have amassed enough NI points that would be needed to claim contributions based esa rather then income based.

God It's all so complicated isn't it?

Thank god for sites like this one. I'd be worrying myself even further If I didn't have the information and advice on here to draw on, so thanks again. :D
