Received WCA telephone appointment but haven't filled out UC50 was created by blissfulblues
My partner was the lead claimant on our couples claim for ESA. We were migrated to UC in February and my previous status as support group didn't carry over to lcw/ra. It never got resolved and citizens advice and welfare rights didn't believe it was worth pursuing to tribunal. So I've been stuck handing in fit notes and doing work coach video chats once a month. No other requirements.
At last work coach meeting last week she asked if I'd received UC50 yet and I said no. She checked and saw none had been posted to me. After the meeting she messaged me on the journal and said she posted one and I had 4 weeks. I received it the other day. Today I got a letter in the post saying next week I had a telephone appointment with maximus for a WCA. My partner called up on my behalf and they said they received information the other day that meant they could go ahead without the uc50. My partner asked what the information was and who sent it but they wouldn't tell us. My partner asked to reschedule to be able to fill in the uc50 and send it back. And they said they would send me out another appointment for end of July beginning of August. Is there anyway to find out what information and from where they received it. I'm a bit scared to be honest.

Hi Blissfulblues
You could put in a Subject Access Request - to see what information they hold on you. They should respond within a month of the request.
It may be that they contacted your doctor for information.

Hi, I'm having real problems and need help. My partner called to reschedule the telephone WCA last week and asked for it to be in august or further out so I had time to fill in and return the uc50 that I only received last week after my work coach posted it on the 2nd july. I was supposed to get help on the 17th but that didn't happen due to being too ill. They can now only help on the 5th August. And my partner called to ask for an extension but was told that they couldn't give an extension because this has been ongoing since march. However I was migrated at the end of Feb and was referred for a WCA in mid to late march but I never received a UC50. Every month I would tell my work coach I hadn't received one. It was my work coach that posted one out on the 2nd July after saying yet again I hadn't received one. I remember them looking at the system and saying there was nothing about failure to send back on my part and one hadn't been posted yet. But the assessment people at maximus are saying it was. I now don't have help to fill in the uc50 and am facing a WCA telephone appointment on the 29th July. My partner called UC and a case manager will be calling us but the deadline is the 15th August. This entire process has exacerbated my poor mental health and I am in a very bad place. Any help at all would be so appreciated.

I'm sorry that this is causing you so much stress.
It says quite clearly on the Maximus website that you can cancel an appointment. You can only do this once - but I would contact Maximus and cancel the one on the 29th if you are not ready. It says you need to give them 48 hrs notice - so I wouldn't do that now, otherwise you will give them plenty of time to rearrange one very quickly near the same date haas.maximusuk.co.uk/benefits-we-assess/universal-credit-uc/. You tell them you are cancelling the appointment, because you have not been given sufficient time to complete the form and under the Equality Act they should be making reasonable adjustments and allowing you to get help to complete the form. Unfortunately, you will have to agree to the second appointment they offer you or you will put your benefits at risk.
Is your partner able to help you with the form, if you use our guide?

We originally were sent an appointment for the 18th July. And my partner called up when we received it and explained what happened and told them we needed the time to fill in the form we had just received. That we needed at least 4 weeks. They then sent out another for the 28th July. We didn't know about the once thing. We don't know how any of this works. So then, this means I have to do the WCA on the 28th when I haven't even been able to fill in a UC50? What will happen if I'm found fit for work. How will I challenge it if they have no information on my conditions or how they affect me. I have really severe anxiety and may not be able to speak or tell them everything during the WCA. I've had panic attacks before at them and dissociated even on diazepam. Is there nothing I can do? We weren't sent the forms. They referred for a WCA in march but I never got any forms till my work coach in my local jobcentre posted these ones July 2nd. And they're saying they have other information when I don't think they've contacted my GP who's on annual leave and I don't have time to get letters from them or my OT or psychiatrist. Could the case manager help at all? Is there anything we can do?

Sorry didn't answer your other question. My partner is also ill. I am part of his claim for his ESA when migrated. We both have brain fog as a feature of our illnesses. I have energy limiting conditions as well so need someone who can explain it to me and also fill it in for me. He can struggle to follow and understand as well. He receives lcwra and I was the secondary claimant in our joint claim. They closed my support group ESA claim when they joined our claims and never gave me NI credits. I got the NI credits back but my status didn't transfer from my previous ESA claim so this is why I have to do a WCA. Said I had no right to credits only claim for lcw/ra. Have been putting in fit notes for months. Video meeting with work coach once a month because it's very difficult for me to leave the house.
I have contacted welfare rights advisor by email and left a phone message but their contact has been sporadic at best since the start of my migration.
