Inheritence DLA question was created by Mark
Hi I am asking this on behalf of my mother,
My Mother receives the high rate DLA, carers, mobility and also gets pension credits and housing benefit, she is 70 years old and is severely crippled with rheumatoid arthritis.
Her father died recently and has left her quite a large sum of money which she has been told will be more than £20,000, will she have to declare this to the DWP and will it affect her money in any way? if so is there anything she can do about it? like give some to me and my sister and her grandchildren as a gift? is that allowed? she is very worried about this, as she was told off a friend she is only allowed to have £16000 in savings before it will affect her income.
We have no idea what she should do when she gets her inheritance so any advice would be greatly appreciated thank you.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

I'm afraid we can't give detailed financial advice on the forum, your mother should get face to face advice from a trained advisor, do an internet search for "welfare advice" with her postcode, town or county.
Her DLA should not be effected as it is not means tested.
I would expect both her Pension Credit and Housing Benefit to be effected but cannot state to what extent.
She cannot give the money away, this would be classed as deprivation of capital.
She does need to inform the DWP and her Local Authority of the inheritance, ideally within 30 days of her receiving it, so it is important that she get advice as soon as she can.

Hi Mark,
You don't state whether your mother is in receipt of the Guaranteed element of Pension Credit, or if it is Savings Credit?
If it is the Guaranteed Pension Credit and she has been awarded a Fixed Assessment Period of either 5 or 7 years, and she is still within that period, then it does not matter if she wins a million on the lottery, her benefits will not be affected, although she should, I think, report it.
She should have leaflets with her award letters (pension credit) which would explain this.

Ok thank you both for your replies, I will see if i can make an appointment with a welfare rights advisor for her, I am pretty sure she gets the guaranteed credit element anyway thanks again for the help.
