WRAG First Interview refused telephone interview

Hello, I was recently placed into WRAG after being on IB since 2000. I suffer from quite bad anxiety and depression for which I have previously been hospitalised. Also I have problems with panic attacks and blackouts usually in social situations. I rarely go out, but because I live alone I need to go to the supermarket once every 10 days or so. I go at quiet times, usually late and use the self service check outs. Because I am able to go to the supermarket it was stated in my medical report I would be unlikely to qualify for the support group. I was relieved to learn that job centre advisors have the discretion to allow telephone interviews for people in WRAG with difficulties getting out. However I spoke to my advisor by phone today and she informed that she as no discretion what so ever and I will have to attend in person or risk being sanctioned. Her position as having no discretion seems to contradict other peoples experiences. Any thoughts would be greatly appreciated.

It is possible that JC+ guidance for advisors has been changed or that the circumstances under which they can use their discretion is limited, it is also possible that the advisor is using this as an excuse to enforce your attendance.

Whatever the reason, your options are limited, their refusing to carry out an interview over the phone is not a challengeable Decision and if they require your attendance you must do so or risk having your benefit sanctioned.

Letter from the doctor explaining why I would not be able to attend done it for me, however the telephone interview did not come up as do not have one and am not legally obliged to have one. I presume JC+ don't do home visits because that was the last I heard from them. I mentioned a few weeks back that I would rather be on WRAG because they leave me alone to get on with my life.

Thank you, Gordon and MrJohnno for the replies. I was hoping that the JC advisor might be willing to make reasonable adjustments or me due to the Discrimination Act. But I have obviously just unlucky with the advisor that I have got. I will see the GP if necessary but I have difficulties attending there as well and he is very reluctant to do home visits. An additional question am I wrong in believing that because I have a prognosis of 18 mths that I will be unlikely to be forced onto a work placement in near future? Apologies if I should have listed this as a separate question.

Your DWP advisor is required to take into account any limitations that result from your conditions, however, by definition, members of the WRAG are expected to be able to take part in some Work Related Activity other wise they would have been placed in the Support Group.

My understanding is that any claimant in the WRAG with a re-assessment period of 18 months or less is eligible to be forwarded to the Work Programme, although I would expect them to prioritise claimants with shorter periods first.

A letter from your GP stating inability to attend 'trumps' this.
