Hello All, I hope you're keeping your heads above water and not worrying too much about what this government is going to throw at us,we must stand together and make ourselves heard when necessary :) .
Anywho on to my question, I need advice on how to proceed with the DWP on a benefit query which basically consists of as follows, I was on Incapacity Benefit until April 2004 when I was told by the benefits people that a disregard that had been in place would no longer be disregarded hence I would not be entitled to ANY benefits, I thought IB was not means tested? I have copies of 2 forms when I applied for IB in 2000 and early 2004 apart from these I haven't much else to prove I was in receipt of Incapacity Benefit as when I moved house 2 years ago (when my query first came to light) I destroyed most of my old benefits paperwork, I have contacted the DWP they say I was getting Income Support at that time? I have told them I believe I was getting IB but they don't agree, in Nov of 2004 I received an IB50 form which would surely mean I WAS in receipt of IB wouldn't it? I didn't fill in this form as my benefits had been stopped in April of 2004 I wrote back to them telling them they had stopped my benefits as they said I was not entitled because I had too much capitol due to the disregard being withdrawn and if there was anything I should be made aware of would they please let me know, I received no reply to this.
I have written to and spoken on the phone to someone from the DWP at Gloucester who was shall we say was less than helpful, she put the ball back in my court leaving me to arrange a meeting with someone at my local job centre to discuss my query, who with I have no idea as no one will know who the hell I am or what I'm talking about I'm sure after some 6 years has passed but if it would help me to prove my case I would do this.
I have under the freedom of information Act obtained paper work on my benefit details which appears to be somewhat patchy this doesn't appear very helpful to me but may to someone that knows what they're looking at perhaps.
What I need is someone to help/advise me maybe someone who knows benefit law, the benefits system inside out,? I would like solid advise to see if I have a case to pursue at first, ie establish/prove I was on IB at that time, if there has been a mistake made by the DWP which at this point of time I truly believe there has been, is there someone other than the CAB ect to help me with this as I really need someone who knows their stuff on my side as there is a considerable amount owed to me if I am correct about this mistake having been made.
Your suggestions please.
Best wishes Condor.... :)
