Potential issue with New Style ESA on migration to UC was created by Anneb
After thinking things going well with the claim for UC managed migration from ESA as Appointee for my son, I have run into a potential problem this morning. I made the claim nearly two weeks ago but have heard nothing about New Style ESA so I phoned the ESA line this morning to ask when I would be notified that my son had got New Style ESA. The advisor said that apparently when I made the claim information was sent to the wrong department and that they were sorting it out now. I asked about making the claimant commitment and he said I’d have to go to the JobCentre with proof of my son’s health problems etc. I thought that this transfer to New Style ESA was to be automatic and as my son was in the support group of ESA all I had to do was give a claimant commitment at the JobCentre. What do I say to these people if it comes to that ?

Hi Anneb
It sounds as if the ESA staff member you talked to was misinformed to say the least.
DWP managers have recently confirmed that the transfer to New Style ESA is automatic as you rightly have said.
You can send a Journal message to the UC case manager requesting information about the next New Style ESA payment.

I requested in the Journal this morning about my son's New Style ESA and the case manager, I assume it was that, replied:
"Unfortunately we are unable to confirm anything to do with New Style ESA because it is still a separate benefit to Universal Credit even though the commitments appointments are being held at the job centres. You will need to contact them with regard to ESA queries."
I don't know the contact number for Weybridge JobCentre which is the JobCentre I went to show my passport and son's, they gave me a slip of paper which is the UC number.

Sorry that this is causing so much difficulty. I suppose you will have to phone them again after all and hopefully get more informed advice.

I phoned the ESA line again and they said just to wait. I then got another issue as the advisor said I'd have to do a Claimant Commitment or the contribution based ESA or New Style when they change it would be discontinued ! Clearly the ESA people don't know how managed migration works so I have little confidence that the system is working.
But then another issue arose because of seeing a reply from you to another person here who is an Appointee like I am....you said Appointees don't do Claimant Commitments, that it's lifted in cases where there are Appointees - but I did one when I made the UC claim for my son - I worry that will now cause a problem because I've accepted the Claimant Commitment thinking it was just to keep the DWP informed of any changes like it says on the BF57 form.
So also, when the New Style ESA eventually comes what do I do as regards being asked to do a Claimant Commitment ? How can I say Claimant Commitments are lifted without any back up to that ?

I think when a DWP employee makes a mistake such as this you should point it out and ask them to take advice from their line manager.
We should not have to locate and show them their own rules.
Let me know how you get on.
