Backdated Housing Element Success...Transitional Protection to be recalculated?

I recently migrated to UC. My rent increased during the the 1st AP but there was a late reporting of this. The Housing Element was increased to reflect the change, and verified as such, but only applied from the 3rd AP it was reported in. This came with the corresponding reduction to my overall TP element.

I have successful convinced DWP that the increase both did occur during the AP, and there was ample good causes for the late reporting, and they have applied the backdation into this 1st AP.

My TP was reduced because of when the Housing Element increased was originally awarded as applying from. However it has now been applied from the 1st AP. I have requested via the Journal that my Transitional Protection be recalculated back to reflec this...

My question is two fold, in that put simply, am I understanding that right about the increases in the 1st AP and the TP affect? As this is a backdation, it would follow that the TP should be recalculated back to reflect that as well. They have sent me the variance in the Housing ELement as a lump sum. The TP however has remained the same thus far...

Hi jasonbudd1984

Thank you for your question, it is outside the remit of the forum. You need to seek specialist advice from your local Welfare Rights Organisation: advicelocal.uk where they can take all your circumstances into consideration when giving you advice.

I would ask on your journal for a mandatory reconsideration.
