If I’ve just been told I’ll move to new style ESA and the rates lower do I claim transitional protection or wait and see what I get from universal credits at end of month

Hi Gail

I'm afraid this is coming up for a lot of people at the point of migration, because claimants are now being told their contribution-based ESA is being moved to NS-ESA during the migration process.

Don't worry too much about the claimant commitment meeting. If you are in the support group then your claimant commitment should simply involve agreeing to report changes in your circumstances, the same as it did for your UC. You can ask for reasonable adjustments to be made, such as the interview to be over the phone (see page 26 here www.benefitsandwork.co.uk/?dlp=68951904881b5)

You should not be asked to provide a fit note, look for work or prepare for work if you are in the support group.

The other thing you need to know is that NS-ESA will be paid separately from UC. NS-ESA is paid fortnightly then the monthly equivalent of it is deducted from your monthly UC payments.

Citizens Advice Help to Claim would be able to calculate exactly what you can expect in your individual circumstances - see page 46 of the managed migration guide above.

Hi Gary and Gail, I hope you are both well. I am also going through same process. Had an alarming phone-appointment call from local Job Centre worker yesterday who said this: “you’ve been kept on ESA for another year. I don’t know why. Decision from way above my pay grade. You will get it twice a week, then after a year it will fully revert to UC.” I did record this entire “false news” phone call. I assume what she should have said was “You have been moved to New Style ESA. You will remain in the Support Group, like you were intil last month, on the old style ESA. You will not be required to engage in work activities. You will remain in receipt of this non-means-tested benefit until a review is triggered in any way.” Am I right? And should I just leave it? Will I receive a letter formally setting all of this out? Thank you for clarifying! Porridge x

Hi plinth

Something does not sound correct, you have to very careful as there are scammers out there trying to gather information.

If you are up to it, you may want to contact your local job centre to get confirmation the phone call was legitimate.
