Please does anyone know if autistic shutdowns count as overwhelming psychological distress? Shutdowns that either lead to partial lack of functioning or full lack of functioning. Assessor saying no panic attacks so not OPD

Hi Perdita

There is no legal definition for "overwhelming psychological distress," so it has to be more extreme than someone being anxious or worried. I can't answer your question because the assessor will make a decision based on what is described. If there is only partial functioning or a complete loss of functioning, you can argue that this is due to overwhelming psychological distress - but I'm not the one you have to convince!

BIS The thing is, this person gets shutdowns in social interaction scenarios but we think he would definitely have 100% shutdown attempting an unfamiliar journey alone. He has always avoided even attempting because of this. So it is a case of complete avoidance doing the activity, but if he had to do the activity he would have to have another person with him. But it involves an 'avoidance' argument, because he hasn't ever attempted it. Can they score on this avoidance basis? I think LL26 mentioned once that avoidance is real as an argument due to past Case Law for other stuff. What do you think?

It is hard for mods to answer your post as we do not know the individual, you said the LL26 mentioned case law, have you checked out the website PIP info: pipinfo.net where you may find the answer you are looking for.
