Hi

I got a letter today from DWP .
looking into my claim . Changes in law to do with engaging face to face .

it says i have looked at your award before 28 April 2022 and is not affected.

It refers to case law MM v DWP.

Now during covid , i got a call from DWP and it mentioned a change in law and they thought I was affected. But at the time , i just couldnt face talking to the DWP , ive had to appeal every review and gone to Tribunal twice, taken to the wire , twice ..

Is there anything I need to look at to see if Im affected.

I suffer with Depression and Anxiety along with Arthritis Fibromyalgia CFS Chronic pain and do not socialise much at all and suffer anxiety in crowds etc , all of which was in claim . However , last review , again had to appeal , day before Tribunal end date , got the DWP call .
After much to ing and froing I sucessfully got 12 points on both , but scored 0 on Avctivity 9 , which I let go .

Anyone else had this? and is it worth pursuing? given I do have evidence to support this , but you know what they are like , they continue either dismiss pain or MH .

any thoughts ?

You had the call saying that they 'thought' you might be affected. They have now decided that you weren't. I'm sure it says in your letter that if you don't agree with the decision you can appeal.

Is it worth it? Some people have successfully appealed. One of the issues that often comes up with this question is the DWP decides that some one 'chooses not to' rather than 'they can't do something."

Have a look at the Guide to PIP claims and Reviews - page 73 - 77 and see how you can strengthen your argument. Have a look at what it says about reliability - and you will need to closely link in your different conditions. It's not just the conditions per se it's showing how they make it difficult or impossible for you to do it.

oh dear , just re posted this topic under another heading ! sorry BIS ! as I thought this one had not reached you !

The end of the letter says :

If you think it could be affected by these changes in PIP law , please phone or write to us using the details at the top of the letter .

postcode WV98 2EU and 0800 121 4433 ? I found your template letter and can use that . Im cross they havenet included MH and engagement on my last review, in fact I did post a topic on it , on here , but clearly the DWP were noy including it what so ever for ( we now know some reason, politics maybe) and awarded the higher points for personal care , i did have to argue for the 1pt of medication aid, quoting regulation 4, so warning to all, dont let that go , as that 1 pt put me onto the enhanced rate. Quite right too.
