Asked to work/ go on Restart while submitting fit notes-please help!

Hi everyone,

I've been off work for a long time due to a serious neurological injury. I am still employed but on nil pay and about to be given a final warning for sickness absence and then presumably sacked. I've been submitting regular sick notes to UC.

I sent the UC50 off but was informed there is a very long delay for assessment, up to 4 months

I have just been asked to go on a mandatory restart course while off sick and made to find a job. I'm really upset about this as my issues will make it impossible (bladder issues, a spinal cord injury and severe depression, and the harassment is making my suicidal impulses flare up).

I'm also worried that if I try to force myself to do it under threat of sanction (although it will almost certainly make my condition progression and be extremely painful and humiliating) they will then use that to end the WCA process, as I was told you could only be considered for this if under a certain wage. I am also worried it is some kind of trick to manufacture 'evidence' that I can work.

Please could you advise as to the best course of action and whether they are following the correct process? My GP does not write reports or letters so I can't get them to intervene and my neurologist is currently out of office.

Your employer cannot dismiss you just because you’ve become disabled. Have they offered you reasonable adjustments and proved conclusively that there is no way you can do the job even with all the possible adjustments ? As a disabled person you’re protected by the Equality Act 2010.
