Hi,
I currently remain on legacy benefits but will presumably be migrated this year.
I am in the support group ESA and get the severe disability premium. I also get housing benefit.
As it stands, if my rent increases, provided it doesn't exceed the LHA, then that increase is covered without it affecting my other benefit income.
However, it seems to me that this will not be the case when I migrate as any rent increase will erode the Transitional Element of the UC award.
This seems to go against the espoused intention of the Transitional Element to maintain the same income as with the legacy benefits.
Have I understood this correctly?

UC was designed with the intention of cutting back on the Benefits bill. So it is no surprise that a lot more claimants are worse off than better off. Transitional Protection eases the pain for a year to two but as you say is gradually eroded.
LHA rates only apply to private renters and have been frozen for 12 months by the new Labour Government. There will be no increase anyway to eat into your Transitional Protection. So private tenants will have to fork out for the rent increase from their UC personal allowance and need assistance with their low budget from the Foodbank.

Hello David,
As mentioned in a previous post I was given a section 21 notice.
At my existing place I get housing benefit and pay the difference to pay the full rent.
In case the rent of my new place is even higher that it is at my existing place, am I correct in thinking that I will get the universal credit amount I should get and that I will still get the transitional protection of my UC?

Unfortunately you will have to continue to pay the difference between the LHA and the actual rent. UC uses LHA rent amounts in exactly the same way as Housing Benefit. As I earlier remarked LHA is frozen at present so that won't affect Transitional Protection.
