Hi, My husband was placed in the Support group a couple of years ago without a face to face medical, we received the new ESA 50 Form and filled it in four months back, we have just received a letter from jobcentreplus saying:-
YOUR CLAIM FOR ESA
We have looked at your claim again following a recent change,
From April 2013 your ESA Allowance will be £**.** ,
on the last page it breaks down the money, Now the money is the same as always and mentions Because you are in the Support Group. Is this the letter that indicates a successful claim or not, I Would have thought it would have said Support group success on the first ?
Also:-
It says that your partner [Me, my husbands carer] may be required to take part in a work focused interview with a personal advisor once you have been claiming benefit for more than 26 Weeks. Your partner will be notified if they are required to attend.
Is this right ? Is this just a standard letter that includes this, if they read my claim they will realise that I Need to care and be with my husband all the time for life so dont understand this.
Last thing:-
If this is a successful claim and my husband is in the Support group without a face to face medical etc. again I Have heard mentioned asking for a ESA85A, do I Just ring them up and what exactly do I Say or ask for ? Do they send out in writing why my husband was put in the support group ? If someone can put down in a step by step what to ask for on the phone first then next etc.

Yes, this certainly sounds like a decision notice as there have been no recent changes in ESA rates etc. DWP are not known for the clarity of their communications, I'm afraid!
If you wish to know when to expect reassessment you can phone and ask for the ESA85a. Or you can submit a written 'Subject Access Request' and ask for all the paperwork held by DWP relating to your husband's claim. This FAQ is relevant even though your husband did not have a face2face assessment

If this is a joint claim then yes, you can be required to attend an appointment with a JobCentre adviser. If such an appointment arrives then I suggest you phone the adviser and explain your situation.

When you say a joint claim, does this mean because we are married ?

You do not need to be married to be considered a partner to the main claimant and therefore part of the claim, however, you do need to be receiving Income Related ESA in part or in whole for it to apply.

Sorry agai, which of the Subject Access Request forms do I Fill in, by the way it wont download or open, do I Need to change settings on my computer ? Thanks for your help
