LCW one year after being an in patient? was created by Cassandra Burton
I am unclear about whether I should be assessed as having LCW for one year after having been an inpatient in hospital. I have been, and am still receiving regular treatment, although not in a rehabilitation live-in setting?

Being a hospital in-patient does mean that you would be treated as having LCW, however, if you are not currently receiving ESA then the most that you can backdate a claim is three months, also, if you are no longer an in-patient then your period of LCW will have ceased and you will now be assessed for ESA as normal.
