WRAG, Works Programme and chain of command query

After a recent medical my son with ME has been placed back in the WRAG group but conditions have changed since last time and now it seems everyone has to go into the Works Programme. (last time he only had to attend one induction meeting)

He was told last time by the Job Centre Plus adviser not to sign anything as that would commit him to two years in the W P.

Now he is supposedly in the WP for 2 years anyway even though we know he will be reviewed by ESA50 within 12 months.

When he goes to the induction meeting next week will he have to sign some sort of documents that commit him and cannot be revoked?

If he gets pressurised by his personal adviser or we feel that his action plan is unrealistic who do we appeal to?

I am trying to keep an open mind about the WP and WFI's and how he will cope and what they will require of him- but it is best to be prepared

thanks

The Moderators are not really up to speed with the day to day responsibilities of the Work Programme so we are limited on the advice we can provide.

As far as I am aware, at the heart of Work Related Activity, whether it be the DWP or a Work Programme Provider, is an Action Plan. This should be agreed by the advisor and the claimant and should take into account any limitations that result from the claimants conditions, if the claimant does not agree with the plan then they should be able to escalate it to a supervisor.

On the other hand, you need to remember that failing to participate in Work Related Activity can lead to sanctions being applied to the claimants benefit.

Perhaps some of the members already involved in the WP can also comment.

Have a look at this, might give an idea, not sure if it is current or not as things keep changing www.dwp.gov.uk/docs/wp-pg-chapter-2.pdf

I would be very reluctant to sign any commitment until I knew all the facts as once signed there is no going back.

Thanks for advice in both replies.

I have waded through all the info at
www.dwp.gov.uk/supplying-dwp/what-we-buy...ramme-provider.shtml

We will have to see how things go and how his WFI's are set up and what is suggested re his Action Plan.- mandatory or otherwise.

His Jobcentre Plus adviser who we have seen for many years was quite apologetic that he was part of the mandatory WP group and said really the WP wasn't for 'people like him.'

The last time they gave him the full two years in WRAG but this time just 12 months even though the DWP Decision Maker agreed that his ME fluctuated so badly he was not able to do a job.

I didn't realise the consequences that the 12 months decision would mean.

We may have a chance to challenge the arbitrary time frame with our next ESA50 when the medical results in O points and we have our next encounter with a Decision Maker.

He has had ME for 13 years. Oh how marvellous it would be if we thought he could be resuming
a 'normal life' in the 104 week time frame of the WP!

In the mean time if we learn anything during our journey in the WP that I think may help others on the forum I will report back.

Thanks again
