Should i be concerned was created by Patel
I am already in support group. Awarded for 18 months last March. Submitted ESA form by hand on
17 th May 013. Nearly 16 weeks since submission. No news at all until now. Prefer not to chase
up
a) Am I at default for not contacting DWP/ATOS
b) Assuming ATOS has sent recommendation to DWP within 16 weeks
c) Assuming as not called for face to face so far paper work alone sufficient to make recommendation
d) Total rejection of WRAG/Support group unlikely.
Kindly advice me on above and let me know if OK to leave matters as they are.
Regards
Patel

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Patel,
As long as your form was received on time (which it must have been otherwise payment would probably have been stopped) then you do not need to do anything else.
You are right that you cannot be found fit for work without a face2face assessment. However, there is no time-frame for ATOS to make their decision. 16 weeks is quite a long time but some of our members have waited longer and still been called for a face2face assessment, so you cannot read anything into the lack of communication at this stage.
If you wish, you can contact ATOS to find out what is happening but you certainly are under no obligation to do so.

Hi P,
If you are certain that ATOS received the ESA50 on 17/05/13, and have some proof of delivery, then the ball is firmly in their court.
I should imagine that if ATOS did not have The ESA50 by the deadline, which seems to be circa May 2013, that they would have returned your file to The DWP, and payments of your ESA would have ceased.
It is perfectly plausible that ATOS have made recommendations on the paper evidence alone, and your file is now with The DWP DM.
The only way to be sure of where your reassessment is up to, is to contact ATOS or The DWP.
