I have been claiming ESA for more than two years and I will face ESA reassessment soon. I heard that under current legislation every three years everyone claiming ESA needs to have a compulsory medical examination at ATOS centre. Could someone tell me if this is true? Could you also point me to the proper legislation. Thank you for your help :-)

ESA is awarded on an indefinite basis but with regular re-assessments, at this time the longest periods between re-assessments is two years for members of the WRAG and three years for members of the Support Group. The re-assessment period is not defined in the legislation other than for a minimum period of three months, but is rather defined by the DWP and usually set from the prognosis period on the ATOS medical report, it does not form part of the Decision and cannot be challenged.

Assessments do not always require a face to face interview, I would distinguish them from a medical examination as there is little if any medical investigation done. A recommendation can be made to the DWP without one if the ATOS assessor believes that there is sufficient information in the claimants ESA50, any evidence that is attached to and any evidence that ATOS collect on their own behalf.

Hi m_c,

Recently, several of our members have again been placed into The SG on reassessment without the need of a face to face, after previously being in The SG for 2-3 years.

As Gordon says, the more compelling the evidence that you provide with the ESA50 is, the more chance that you will not have to go through a face to face.

There are no guarantees of this, I'm afraid.
