i have won my appeal today thanks to all the help i got through this site , i,m so happy after all the months off turmoil , the DWP gave me £70 a week while i was waiting for appeal because i had all my doctors fit for work notes , am i entitled to any other rebate now my appeal has been won , and do i need to ask for any other help as i am unsure off what happens now .... once again many many thanks for allyour help :) :S

Thank you for letting us know your good news and for your kind words about this site :) which grou were you put into?

ESA is an open-ended award without a set time period so the award letter will not tell you when to expect reassessment. Some tribunals do state that the claimant should not be reassessed for x time, but this is only advisory and DWP do ignore it. If you wish to find out when to expect reassessment you can phone DWP to ask for the 'prognosis' but you should probably wait until you get the formal decision letter from DWP. unfortunately, this can take several months and you will not get your backpay until then. It would be worth still sending in sicknotes until you get this letter as that will ensure that payment continues smoothly.

Eventually your backpay will land in your bank account. This will be the difference between the assessment rate and the new rate (depending on which group you are in) going back to the first day of week 14 of your claim (if this was a new claim) or the date your IB/IS finished (if this was a migration from one of those benefits).

thanks for your advice , it is very helpful , the guy at the appeal said he would be sending my won appeal letter out first thing tomorrow . Should i get in contact with DWP or does it automatically get done by the tribunal ... thanks

The Clerk should be sending a copy of the Decision Notice to the DWP but it can take a couple of weeks just to make it through their internal mail system.

You may be able to shorten the time by sending a copy of the Notice directly to the ESA Payments section, either by fax or my email from a JC+ office, you will need an appointment for this.

The Judge can recommend a re-assessment date but the DWP are not obliged to honour this, you can challenge an early assessment citing the Tribunal recommendation as reason, members have had varying success with this.
