Hello,after loosing my esa appeal l on anietty and depression re applied for esa along with my other conditions,l have been awarded esa again,l now have the limited capability for work questionere to fill in again,age concern can help but theres a 5-10 working days before they can help,hubby has downloaded help pages from this site and will help me fill the form,my question is if l fail again l don't think l can go on with esa its causing to much stress to me,h,l have high care and high mobility indefinatley,if hubby clames income support as he is on carers allowance,would dwp question my dla now and not after 2015,would dwp concider im fit for work even tho im not if l gave up esa fight and let hubby claim,im .l hope this makes sence,my gp is very supportive,buut will see the medical through and see what comes of it.

You need to speak to a qualified advisor about the options available to you as there are both short and long term implications that you need to be aware of before making any decisions.

Where to get advice?

In principle your husband can claim Income Support as a Carer, doing so should not affect your DLA, but you need to be aware the IS will be replaced by Universal Credit and the rules for Carers will change when this happens.

If you are found Fit for Work, it is possible that this will trigger a re-assessment of your DLA claim, it may not, but given that you are receiving the higher rate for both elements, I think it likely that it will happen. If you do not challenge the ESA Decision it may undermine your claim for DLA.

a late thank you Gordon,and another question,my hubby today enquired at age uk as they say l will have a five to ten days before anyone can help me with esa questionnaire which has to be in by 3rd sept,hubby has printed out the info of this site re form filling in,as there is no one to help at the moment in my area, hubby is going to pre write answers for work questioner using the guides printed,my question is if anyone could help is,im on a lot of medication per day including pain killers,they nearly all appear to have the same after affects of some of my conditions ie fatigue dizziness balance probs ,l have cronic vertigo,arthritis both hips and multipul joints,s,underactive thyroid,high blood pressure,diabetic type two difficultis ito control,diabetic neurophaty,how do l explain which medication is causeing side affects ect,l know my pain killers leave me feeling lethargic drained if l take a lot my speech feels sleared ect and l cant think as quick as l would like,so do l put how conditions affect me,but how do l say about side affects of meds ?

If you can clearly identify one medicine causing one side effect then you can go from there, but if it is a case that several medicines have the same side effects, or more likely, that you cannot specifically identify which is causing a problem, then just explain as best you can on the form.

Try and think of the problems in relation to the ESA Descriptors, so you mention problems with dizziness and balance, these would be applicable to the Mobilising and standing and Sitting Descriptors but probably not to the Communicating with Others one.

You could write you suffer from sleep deprivation due to your condition and/or medication which causes tiredness and fatigue and you would be a substantial risk at a work station
You would also be a substantial risk if you explained your balance problems , vertigo, dizzines etc and explain the restrictions and limitations
