Hi, new to the forum.just a quick background.had a back & ankle work injury in 1992.on invalidity and incapacity benefits until now since 1992, assesed at 50% industrial disablement for life digenerative back, miners beat knee and pnuemoconius of the lungs,spondllosis of the neck all caused by working underground in the mines,new left hip replaced 2013 waiting surgery 11 september for right hip replacement.got a medical 23 august, asked for groundfloor and recorded medical, any advise I would be greatfull of , thanks

Hi Db,

My best advice would be treat the assessment as starting from when you leave home, until your return.

Assumptions will be made on how you managed the return trip to and from the assessment.

You may be observed approaching the building, whilst inside and on leaving. Again, assumptions may be made by the assessing HCP.

what i cannot understand is that atos assesed me at 20% industrial disablement last year for life,with the discripters of unable to walk . bend , kneel and sit,

Hi Db,

I afraid it is a case of different benefit, different qualifying criteria.

e.g. With ESA is is not simply a walking test, it also takes into account whether you can self propel a manual wheelchair unaided, even if you have never used one.

Bending and kneeling are no longer part of The ESA WCA (Assessment)

It is not just sitting, it can be a combination of sitting and standing.

May I suggest that you have a read through :
