Trebor wrote: I did appeal for the supersession and sent in a new ESA 50 filled out properly this time and sent in a doctor's report about my depression my hip and knees also my back problems and how tired I was because of my diabetes, I sent in a SAR and when I hadn't heard anything after four weeks I telephone them only to be told they haven't received it but they did agree if I went to my local jobcentre office with ID they would fax the information through to me, I was told they didn't have any medical reports the only information they had was my original ESA 50, I have had a letter from them dated the 5th of July saying they had not changed their original decision, so is that it or can I appeal again if so what do I appeal against is it the supersession or do I just give up.
As a new Decision on your claim has been made, you can now lodge an appeal against it, however, you still will not receive payment unless you are placed in the Support Group, although you would receive back payments to the date that the Supersession Decision was made.

I am appealing against your decision on the supersession, I do not believe that the decision maker took full account of the severity of my condition or of the way that it affects my everyday life,
Or should I include
I wish to have an oral hearing so that I can explain the full effects of my condition to a tribunal and answer any questions they may wish to ask.
While I was down my local job centre to pick up the information for my SAR which they give to me verbally saying it was my original ESA 50 they were using against me and had no medical evidence, I have since sent in another SAR so I can have it in writing, the two young ladies I spoke to were giving me advice on the best way to fill out the forms I did mention to them that the problem was I didn't have anyone to help me fill out forms and they said they were sorry but they couldn't help me to fill out forms but they did say as soon as I appealed I would get my £71 living allowance until the tribunal, last Friday the 19th of July 1 of the young ladies telephone me to say they had given me misinformation but they could arrange for someone to call to the house to help me fill out any forms I needed, this morning I had a telephone call from a lady from DWP to arrange for a gentleman to call on me on the 30th of July to help me fill out the GL 24 and he would telephone me closer to the date to arrange a time, the date on the decision notice is the 5th of July it is pushing it a bit close but I can hand deliver it if I've got to, has anyone heard of this happening before.

If you have a look at the link that I posted previously, our ESA Appeal guide explains how to complete the GL24 Appeal form and how to approach an appeal.
In addition, as you already spent 365 days in the WRAG, you will not receive any payments while you appeal, the young ladies who told you would receive £71 are unfortunately, incorrect!

No seriously a gentleman from the Department of Works and pensions called out to help me fill in the GL24 appeals form on the 30th July, I had already typed out my appeal and planned to write some on the appeal form and attach the rest of it, but he said there was no need he would attach it to the GL24 and hand it in himself, I personally think he just came out to take a look at me and report back,
I have had a phone call this morning 4th October from the Department of Works and pensions the lady informed me that I was to be moved to the support group for three years and I would not be bothered again and my money would be backdated to March last year and she would send me a letter confirming this, I think this is a mistake and probably meant March this year.
The best thing that has happened to me in a long time is finding this site benefits and work and the mods have given me the confidence to fight on the information I have been given and found has been fantastic, now to get ready to fight for my DLA and I will be ready this time, so a very big thank you from me for all the help you give I will keep you updated.
