ESA Appeal was created by JLP
After my request to the DWP they have finally sent me a copy of the ESA85A. Attached to this is a copy of the ESA113 form that was sent to my GP. I can hardly read what the GP has written. I have asked two other people and they say they cant read it either.

If we cant read it, then how are the DWP DM, or the tribunal service going to read what the doctor has written?

I was going to write to the DWP for a translation of the document.

Any ideas about what I can do would be very welcome.

Hi JCP,

If the ESA113 was illegible, the DWP/ATOS should have returned it to your G.P. and asked for it to be made legible.

If the DWP/ATOS state that they have used the ESA113 as evidence in coming to the decision, how could they have done so, if it is illegible?.

As it was your G.P. that wrote it, you could make a very diplomatic request for them to "translate" it for you.

However, as the ESA113 is a DWP document, and the G.P. only has to fill this in if requested to do so by the DWP, your G.P. is under no obligation to comply with your request.

So it would depend on what type of relationship you have with your G.P. and whether they would be approachable and sympathetic to any such request made by you.

Failing that, query it with the DWP.

Hi, I have another GP now in a totally different area. I also did not really know the GP who wrote this report.

Hi JLP,

Therefore, your only other choice is to kick it back to The DWP, and ask them how it was taken into account as evidence if it is illegible, and what do they intend to do about it.

The problem is, that information supplied in the ESA113 by a G.P. is usually pretty general.

Even if the G,P.'s comments were really supportive of you being placed into The SG, although this may help with your appeal, the DWP/ATOS do not have to take heed of the G.P. comments within the ESA113.
