Hi B,

There is no legal definition of "Substantial Risk", it is up to the DM on whether they consider that there would be a Substantial Risk caused to you or others, if you were not found to have LCW. (Placed in The WRAG)

It is sometimes used when it is considered that you do have LCW, but The DM cannot award you the 15 points needed.

Can I ask you a few more questions that was on the ESA85a which i dont understand.

The HCP mentioned the Med3.
The last time I was asked for a fit note was 1999.

1/ Is she taking the information from the med3 from 1999

2/ she states, the med3 confirms surgical treatment.

when she says, surgical treatment,does she actually mean the surgery was successful

3/ She also states. Further surgery may be considered and would likely to meet threshold at
examination, I do not understand this.

4/what does this mean, Long term incapacity noted and previous accept noted

Hi B,

We have heard from members where a MED 3 is referred to when the member has never had a MED 3 issued by their G.P.

The current MED 3 "Fit Note" only came into being in April 2010.

We think the MED 3 is referred to, as the LiMA software used to compile the report includes "stock phrases". In this scenario, the ATOS HCP is not amending this phrase.

As for the rest of your queries, any answers that I could provide would be pure speculation.

The best thing to do, is to write any queries that you may have in a letter and post them to The DWP as a formal SAR request.

Hi B,

If you have been given the e-mail address of The Data Controller, I don;t see any reason why you shouldn't use it.

You could post hard copy as well as a back up, and put " Sent By E-Mail and Post" at the top of the request.

Hi Bro

E-mailed that SAR request, asking which Regulation or descriptor I qualified for Wrag and also some queries.
I received a reply within two hours.
Saying she was passing it on to the DM that dealt with my decision, but my papers have been progressed to the appeals department, and will contact me in due course.

Two hours beats two months I waited for my other Sar :lol:

Hopefully it will be a nice light letter coming through the letter box and not a thump of appeal papers. But Iam geared up for the appeal, don`t expect them changing.
