Just thought I would let you know that thanks to you and this site, I won . Though I dont think im out of the woods yet as was placed in work related activity and not sure what happens there and how long till i hear from anyone. It was reccomended I dont get reassessed for 24 months. (I am 59 yers old ) also my contribution based esa runs out in june, so will it still run out anyway ? Probably wouldnt get income related esa as my husbanndand gets state pension and bit of work pension and I get work pension as was medically retire from nhs job 6 years ago. Confused what happens now. Any info greatly appreciated. Thanks. Patty. Was M

Congratulations on winning your appeal.

As you are now in the WRAG, you may be contacted by your local JC+ in regard your attending a WFI, however, given the re-assessment period and the fact that your payments stop in June I think it unlikely that this will happen.

It is worth checking on whether you are eligible for ESA(IR) after June, as it passports you onto a range of other benefits such as free prescriptions and dental care, as long as more than 10p is payable you should be eligible.

I would have a look at one of the online benefit calculators, to see whether you are eligible, try www.turn2us.org.uk/

Hi Patty,

Well done for winning your appeal!

Just to add a warning to Gordon's excellent advice - the 24 month reassessment is only a recommendation, it has no weight in law, and it appears that DWP very often ignore this and start the process sooner. Of course, this is not neccessarily a bad thing if it results in you being put into the Support Group and payments resuming!

Hi Mrs H, I sent a post earlier but dont know who to. just to let you know I won my appeal yesterday and says on the decision notice, am entitled with work related activity component, not sure what this is, will I have to keep going to the jobcentre ? The tribunal reccomend the department does not reassess me within 24 months. it also says no schedule 3 descriptor is applied, I don't know what that is either.

My contribution based ESA (which I have been getting at assesment rate ) runs out in June, does this mean it will still run out or will it start another 12 months, I have done 38 years work where I have payed my contributions.

sorry to be asking you all these things but am so confused, also do I have to still get sick notes from my doctor and will my full rate of ESE be reinstated, and will I get any backpay for what I have lost.
Any help greatly appreciated. looking through your guides helped me win I am sure, so thankyou, I just wish I had found you sooner.
Patty.
