My esa50 was received by Atos on Monday 15th April (exactly one week before it was due) so they have had it 4 weeks today.

I rang Atos today to query the progress and was told they do not need to see me for a medical and my file was returned to the DWP on May 1st.

I rang the DWP and they have nothing on their system yet.

I am just posting this for info as I know many people have queries re the time taken for various stages of the migration process. I am in the Huddersfield area.

Interesting note, I was told that if the ESA claim is a migration then the DWP usually notify of you of the outcome by telephone then they follow with a letter of confirmation but if it is a straight ESA claim or reclaim rather than a migration the first notification of the outcome is by letter.

Again, just posting this for info as I had not heard it before and had wondered why some people were telephoned with the result and others not.

The positive aspect of this information is that as you are not being required to attend a face to face, you cannot be found fit for work.

So it looks like WRAG or SG for you, fingers crossed. :)

I have just received a telephone call from a very polite and friendly man at the DWP to inform me that I have been put into the support group for 3 years. He confirmed the exact amount I will receive which is what I am on now and confirmed i have continued transitional protection regarding an occupational pension.

He informed me that It will not be taxable because of the transitional protection. I did not comment on this but I know he is wrong so I will ensure I contact HMRC myself once the written confirmation arrives.

I would like to say a massive great thank you to everyone involved in the running of this site, i have found it invaluable and have always had swift and clear responses to my queries. I do not believe i would have got this result without your assistance.

I will shortly post a few more words about my claim in the hope they may help others in a similar position.

That's great news, just awaiting the Decision Notice letter now. :)

You are indeed correct, you OP will continue to be disregarded under TP.

You are also correct in that there is no such exemption to tax liability carried forward to ESA.

Will my pension be disregarded under ESA?

My IB was tax exempt; will it still be under ESA?
