Thanks for the reply, its so hard to understand all I need to do while I'm feeling so upset and panicky after hearing this verdict. If i get the ESA assessment rate while I am going through the appeal, what would happen if I then lost the appeal,would I have to pay it all back?

Looking back on your posts I believe you were transferred from IB, so you need to be aware that the Assessment rate is only payable for one year from when your IB claim was closed, appeals are running within this timescale, so it shouldn't be a problem, but it may limit any award you might receive, unless you are eligible for Income Related ESA.

Thanks, yes I was on IB, does that mean the assessment rate while waitng for an appeal would be means tested and have I got to request or apply for it?

No, the assessment rate would not be subject to means testing. You need to tell DWP that you want to be paid(who wouldn't?!) and accompany this with a 'fit note'(sick note, Dr's line, med 3) from your GP, which you will need to keep renewing until your appeal is heard.
