Hi, I am on esa, contribution based and in the support group due to a multitude of health problems. My wife had a car accident which made a long term back problem worse and was signed off sick for 3 months. When she applied for esa she was told that she was not eligible for esa as she had not paid the right n.i. contributions for years ending 09 and 10.
Before my illnesses worsened I was self-employed and she worked for me part-time for 20+ yrs. She was earning under the threshold to pay full n.i. stamp and we assumed (as did our accountant) that she was exempt from paying full stamp. Can anyone confirm if this is right, I am not sure if the standard rules and regs to n.i. contributions apply in her case. She wored full-time from Apr. 2010 to Apr. 2011 (till being made redundant) and paid full stamp but they said that the yr. ending 2011 does not count. Thanks for any advice. M

Hi,

I'm afraid that I don't know enough about NI contributions to be able to answer that question. I think you would need to contact an advice agency and speak to a specialist adviser.

To be eleigible for ESA(CB)

If you are over 20 years of age (or aged 20-25 in certain circumstances) you must have made the following level of National Insurance Contributions:
  • in one of the previous three tax years, have paid some Class 1 or 2 contributions to the value of 25 times the lower earnings limit; and
  • in each of the two previous complete tax years, have paid or been credited with, contributions to the value of 50 times the lower earnings limit.

    I was sort of assuming you would provide the information to your advisor, but I'll have a go.

    The Lower earnings llimit for the last three years are;

    2008 £90
    2009 £95
    2010 £97

    So as an example, you would need have earnt £2250 (25*90) in 2008, £4750 (50*95) in 2009 and £4850 (50*97) in 2010.

    You should of course have these figures checked by an advisor.
