still not satisfied so i called them again as to why they are not giving any care when my mum is really entitled to somthing as she is so ill.i was given the choice reconsider or appeal,so i asked for them to look again as i said its like you are talking about a different person and not my mum,the lady also said it was so unusual for them to reduce the lenth of time of the award.fingers crossed.
also is this usual that you can ask them to reconsider again or is it that that have made a mistake?thanks
Hi Mary,
If the DWP revise an award (as they have in this case by changing from it from Indefiniate to a timed award) and the claimant is not satisifed then the same reconsideration/appeal process restarts.
Hence you can ask for a reconsideration or go straight into the appeal process(where a reconsideration is carried out anyway).
However the same caveat applies that there is a small chance that the claim could be revised downwards as well as upwards.
We would normally advise all claimants to obtain face to face advice to ensure the relative safety of any award prior to taking this course of action due to the small possibility (as happened in this case) of an award being amended downwards.
As two DM's have already confirmed your mum should receive High Rate Mobility then that part of the award 'should' be relatively safe (albeit there is no absolute guarantee).

i thought the hm maybe safe but again like you say you never no with dwp.
reading other peoples experiences am considering apealing as am sure will have better chance on an appeal as like said they still reconsider,is it too late to ring and ask to change for an appeal?

Hi Mary,
No, it's not too late (you have a month from the date of the revised award letter).
You can ring them on 0845 7123456 and ask for an appeal form (called a GL24) or you can download one from here:
www.dwp.gov.uk/docs/gl24dwp.pdf
complete it and send it in. You could ring and tell them you are now appealing and a GL24 will shortly follow. As I said in the previous post, a reconsideration is carried out as part of the appeal process anyway.
If you opt for an Oral Appeal (as opposed to one on paper) it does increase the chances of getting an award as the Appeal Tribunal is essentially a complete 're-run' of the claim and the tribunal panel can see and ask questions of your mum.
