i have just got off the phone to dla and they said the same, i am appealing using the medical assesment as i have had help looking at it and seems that we can go forward with the appeal as he didnt clinically examine my husband and all his report was made on opinion! also am awaiting latst letter from his consultant for evidence so hopefully it will soon be okay. hope you have luck with your appeal aswell.

Whilst it is often important to discredit the ATOS medical report, please remember that ultimately the Tribunal will make it's decision based on whether you meet the criteria for a benefit, so make sure you include evidence that you do.
