ESA Appeal allowed, what next? was created by tommy t toner
Having been on ESA since April 2009 and failed medical in December, my appeal was heard at the beginning of June. Thanks to a brilliant rep from the CAB I was allowed, and received confirmation shortly afterwards. Since then I have still been paid at the £130.90 fortnightly rate, where I expected the rate to rise.
Can anyone tell me what to expect, and as I am approaching 64, will I be sent for any more medicals?
I was moved up from 6 points to 15.

You should be being paid at the work-related activity component rate which is £91.40 a week, in your case £182.80 a fortnight.

You may not have received the correct rate of ESA as yet, because of the volume of work at the JCP/benefit delivery office which handles your claim. However, there is also the possibility that the relevant office have not received a copy of the decision notice from the Tribunals Service.

In view of the uncertainty, it would be in your interest to contact the relevant office, to find out what is happening with your increased payment and arrears of ESA? If they have not received a copy of the tribunal decision notice you can send or take a copy of your decision notice to the DWP office.

On the question as to whether you will have to undergo the WCA again and attend for another medical assessment, it is impossible to tell if this may happen, as the appropriate authority appear to be a law unto themselves in this respect.
