Okay, I didn't realise it was a leap appeal. The judge was only dealing with that - so he could not make any ruling regarding your recent review.
I can see why you have been advised to put in for a mandatory reconsideration. As it is a late one you will have to explain why. (I mean, it's obvious, and they will be able to see from your records) but lay it out clearly that although you disagreed with the decision at the time you were waiting for the result of your leap appeal before putting in an MR.

Apologies if I didn’t put clarity in my earlier posts I’m dyslexic I know what I want to write but doesn’t always come out in the way I’d like yes will ask for a mandatory reconsideration once I get the court papers through and letters from the dwp about back dated payments from that period I believe that can take up to 4 weeks so I’ve got 13 months to put in a mandatory reconsideration if I give them a reason for doing so hence my appeal hearing

Phoned the DWP earlier today my mandatory reconsideration is being allowed the lady on the phone did say I could lose my award stay the same or award increases so here we go again should I send my court letter in with the mandatory reconsideration .

Glad your Mandatory Reconsideration is being allowed. The information she gave you is standard practice for everyone. I would send a copy of your court letter in with your MR.
