honestly I am speechless... I really - just - can't... did they have lobotomies or something?

This is like the muppet show now... haha
So I escalated my complaint as you know. I am literally - I - mean.. what!?? lol
so in my complaint escalation I wrote an entire paragraph about my inability to ask for the assessment to be recorded and that I failed to do so due to ADHD/Autistic shutdown and being barely able to speak and that my difficulties with being able to engage with others and understanding cues in conversations were one of the worst struggles I had..
excerpts from my complaint:
`Your investigation stated that the matter was “inconclusive” due to “no evidence” to validate my concerns. I must correct this: I do have an audio recording of my assessment, made solely for personal use `
`This recording was made as a necessary accessibility measure to ensure I could process and recall the information discussed, and is therefore a reasonable adjustment under Section 20 of the Equality Act 2010.`
I cannot put any of the actual evidence in here but further on where I attached the transcripts of the assessment, I went on to explain why I had not asked for the assessment to be recorded in great detail, outlining how my disabilities prevented me from doing so.
the response to my escalated complaint:
`I note you have mentioned that you audio recorded your PIP assessment. I have checked our records and I can confirm your assessment was not audio recorded by us`
like uh.. I already told them that not once, or twice but mulitple times...

not really expecting a reply to this but I thought it might give someone a chuckle maybe.

Updating this so anyone reading can follow through in case its helpful for them.
I have placed a second complaint with Capita (not sure I posted this here or not so hopefully not repeating myself here)
The second complaint was for how they handled my SAR, they stalled me, gave me wrong information and broke the Equality act etc etc making me jump through hoops, and making everything as difficult as they possibly could for me. Cue my second complaint showing where they misled, misdirected and make the unlevel playing field more unlevel and pretty much inaccessible for me.
I finally corrected the issue myself and my last response to the person I was dealing with was something short and to the point - signposting me to the DWP when the correct place should have been the DFC.
I then copied and pasted the entire e-mail discussion into a complaint and pointed out the law, and breaches they had done - so they have that now.
then I wrote an e-mail requesting that the DFC immediately instructed Capita to comply with my request, and sent them the responses I had recieved from Capita outlining the problems I had had and how I had been treated.
On a separate note, my escalated complaint seems to be progressing after I sent in my personal recording. And AGAIN the eejits messed that up, calling me unexpectedly this morning - putting me on the spot and completely dismissing ALL the problems I have engaging with people and why I can't do that and how that affects me - included in my COC forms and 2 complaints... I thankfully had been working on a similar issue and was in the middle of that which allowed me to avoid completely breaking down and although it resulted in a melt down/panic attack I managed to tell them that what they did - was inconsistent with what they know about me and ringing me out of the blue was really dysregulating as I cannot communicate that way especially if put on the spot. Got off the call after she said she would call me back later.
I was at least prepared for the call and felt much steadier so was able to tell her that I would prefer to have a paper based assessment as I was so traumatised after the last one, and that if they needed further clarification to what they had they could email or write. so we will see how that pans out.

Things seem to be moving faster than a cow patty of a hot shovel here. So now I am a little confused again.
Got a phone call yesterday from Capita - they said that a new assessment had been requested. I opted for paper and told them if they needed clarification, to email or write to me.
Today I got a letter saying my MR had been completed. ?
two things I am confused about.
I specifically stated in my MR I was waiting on SARs; therefore further evidence would be sent to them, I sent more evidence which they received - I did not get any acknowledgement they got that one and I also specifically stated in that as well- I was still waiting on SARs and that I would be forwarding more evidence to them as I was still waiting.
I need extra time not only for the SARs to come in but because of how my disabilities affect me. Should they not have waited?
what happens now if they have completed this MR and Capita reassess me?
This is a lot for my tired, overworked and overwhelmed brain .... its making my head spin.. so many things all happening all at once and none in any logical order that I can determine....
they have clearly a hand book that tells them how to mess with an ADHD person head.

There appears to be a bit of a contradiction here. Why should the DWP Decision Maker wait for information which the DWP hold and are collating to send to you? I expect the Decision Maker would say that he/she has responded to the MR using the information held on you by their IT systems.
The DWP response to the MR has to indicate your next steps by way of a Tribunal if you are not satisfied.

Hi David thank you for your response.
Ah I see so, its not just the DFC that I am waiting on a response from it is the SAR from the hospital trust and my GP and my supporting letter from my Psychiatrist. I did get the GP one back but still waiting on the trust one, DFC did send some of the SAR it but not exactly what I asked for. sorry for the confusion there.
I did inform them I needed more time because for me to gather evidence and then organise it and do all those things takes me 3 or 4 times longer than it would take a non-disabled person. Therefore, they knew I was doing that, so should they not have waited?
My confusion lies in this part inparticular, if the decision has been made on my MR now and Capita are reassessing me following my escalated complaint and after reviewing the recording - does this mean my MR is null and void now or what happens in this instance?

You think that your MR may be null and void now. The question is who is making that decision? Obviously you are but for the decision to be effective it would need to be made by a Benefits Tribunal.
There are published time limits for a MR and the official guidance does not allow extensions to collate evidence. A late submission itself though may be allowed because of a health condition.
The DWP are apparently aware of your situation but have made their decision which is why so many Benefits claimants take Tribunal action.
