Potential issue with New Style ESA on migration to UC

Hi David,

What about my Claimant Commitment issues - the fact that I made a Claimant Commitment on behalf of my son when I made the UC claim as I'm his Appointee - and what about if I'm asked to make one for New Style ESA ?

Hi Anneb

Just refuse and say that according to DWP rules Appointees are never allowed to sign a Claimant Commitment.

Hi David,

I don't know if you've read my message about what was said when I went to the JobCentre about another issue and I mentioned that when it comes to Claimant Commitments they are lifted when there is an Appointee: the JobCentre advisor said that used to be the case but is not the case any more !

I have a telephone appointment to do the Claimant commitment tomorrow (Monday). The letter from ESA also says they will ask about the disabilities or illnesses which prevent working.....I hope that's just a standard letter as my son has had WCA which says they won't ask for another one unless his health conditions change.

Yes I thought I had replied but here is some further information about the subject.

n the front page.

Claimant Commitment
PABs and CABs will not be able to accept a Claimant Commitment on behalf of
the claimant.
For more information about the claimant’s suitability for accepting a Claimant
Commitment, see Claimant Commitment overview and Removal of the
requirement to accept a Claimant Commitment.

The DWP staff should have got their act together by now over the interviews as we are approaching the end game and just when they are fully trained it will be Xmas and Managed Migration will be officially over.

Hi David,

Thank you for that link. It seems that the DWP staff don't know what they're supposed to know. Even the Citizens Advice Help to Claim weren't aware of this.

Fingers crossed things will be okay.
