I received my pip review result and scored 10 for the moving around section. I am considering an MR and wondered if the safety rule means you would always have to be accompanied outside.

Due to some treatment I have fragile bones in my leg that are prone to fracture and also 2 unstable spinal fractures. I have foot drop and trip a lot when walking even with a stick. Any fall could have an increased risk of injury as any leg fracture may not heal and I could suffer further spinal damage. I don't feel this has been taken into account. Can this be sufficient grounds for an MR or would I be wasting my time as I am not in a position to always be accompanied when I go out.

Staggeringly part of the information they had used was an ESA assessment from over 10 years ago despite me sending current evidence.

Only you can decide whether or not its worth putting in for an MR - you're the expert on your condition and understand the impact.

It's quite possible for someone to need to be accompanied, but not have anyone - so you shouldn't let that stop you from challenging the decision. From the little you've said, I would be argue that the assessor has misunderstood the severity of your condition - and argue something like this:

"Fragility and Risk of Re-injury: Due to treatment-related complications, I have fragile bones in my leg and two unstable spinal fractures. This means that even a minor fall could cause serious or irreversible harm. A leg fracture may not heal properly, and I face a very real risk of further spinal damage.

Mobility Limitations: I suffer from foot drop, which makes walking difficult and increases my risk of tripping, even with a walking stick. This significantly affects my balance and coordination.

Pain and Fatigue: I experience ongoing pain, and the physical effort required to walk—even short distances—is both exhausting and distressing. My walking pace is considerably slower than average, and I cannot repeat movements or walk even a short distance without considerable strain or danger. Even when I am accompanied, it does not prevent me from tripping. "

You don't have to use those exact words - you get the picture and as I said you're the expert.

Hi Bis, thank you for taking the time to write such a helpful reply. I really appreciate it.

As part of the review I received an unexpected phone call from the case manager asking how far I could walk. I replied regarding the safely, repeatedly, acceptable standard etc and he became quite irate saying that wasn't what was asked on the form and all but denied that criteria existed.

He also said I had written on the form that I had good days which was totally untrue. When I asked him to read back to me where I had written that he quickly changed the subject and started to make up an answer for me. I stopped him and said he was putting words in to my mouth and that his answer was incorrect. He kept saying I am trying to save you from a full assessment.

At the end of the call he said to me I know I am ringing at your worst time of day as I know mornings are particularly difficult for you, which seemed a strange thing to admit.

I never was sent for a full assessment and in the decision he said my circumstances have changed and was giving me a longer award even though it was for the same length of time as my last review.

This phone call has left me feeling quite unsettled. My question is are they still able to totally cancel this decision if I put in for an MR and make me fill out a new form and have a full assessment as he kept calling it as I am not sure I can face that.

He's talking twaddle. You have had a full assessment! They decided to do a paper-based assessment. He's talking nonsense, saying that he's trying to save you from a full assessment. They can't turn around and say that a paper-based assessment isn't good enough or equal to the other types of assessment, when the assessment has clearly been completed. They do paper-based assessments because they have decided they have sufficient information, and generally don't need to speak to the claimant. And you know it's been completed because you had written confirmation! I do dislike it when they try and lie through their teeth over the phone about what you people have written. I am intrigued why the case manager suddenly phoned you.

You are entitled to put in for an MR. They can't suddenly cancel the paper-based assessment - they have to follow the process through.

Hi Bis, many thanks. That is helpful to know.

It is the first time I have come across such a blatant attempt to persuade me in to a different answer. I had sent a 4 page medical report that backed up everything I had said on the form but he told me he had not read it before ringing me. He had however read a 10 year old ESA report that is totally out of date.

Hi an ex nurse.

I have a risk of a fall and severe pain when walking.

Bis encouraged me to do an MR that was turned down and he encouraged to do an appeal.

After 6 weeks from when I put the appeal the DWP called me and awarded me enhanced mobility component.

I was awarded me the enhanced mobility back to May 2024.

It is worth having an MR and if that doesn't work to take it to appeal. You must put in your appeal within 28 days from the date on the MR decision.
