Transitional Protection and the Housing Element

The Housing Element of Universal Credit will not exceed the LHA. As previously explained if your Housing Benefit is higher than the Housing Element of UC then this will be reflected in the transitional protection.

Many thanks for your reply.

To answer your question, I do not know of a reason why my TP should not include the difference between the LHA and my previous HB. The payment calculation only stated that no TP would be paid due to UC not paying more than the LHA

I've followed your advice and been in touch with Help to Claim, where my queries were passed on to a supervisor. I've now received a long reply but at first reading it appears contradictory and non conclusive. Unfortunately I cannot reply to it for clarification, as the 'email account is not monitored'. I will read it again when my head is clearer and get back to you if that is okay. Thanks again.

Thanks for your reply.

However I am still not clear if TP is meant to apply to the TOTAL sum one receives, or to specific elements of it separately. I presume it is the former, but I don't know.

I've crunched a few numbers, and if TP applies to the total sum one receives, then I may end up a situation where I get some TP because the Housing Element being lower, but that will be offset because the other elements of my UC claim would go up a little. I'd still be slightly better though, which of course is a lot better than being £1300 worse off! Thanks.
