Hi some advice please, abit of medical history I was paralysed 16 years ago and found to have a arachnoid cyst crushed my spinal cord, had thoracic laminectomy (cut into my spine to get to the spinal cord) to drain the cyst, had to learn to walk again, ever since I have had to live with the daily pain as the compression permanently bruised my spinal cord and damaged the nerve roots, so I have daily chronic nerve pain in all my back round my ribs and down in my legs, the more I do the more the pain gets worse, also have depression and anxiety due to it, I do go to work and try and cope day to day,
The assessment nurse was nice and we went through everything, I got copy of my report today and she has marked me A’s through all the descriptors, but recommendation / descriptors supported has been considered B’s E’s or D’s, and said through out the report that because I go to work I can do this that and the other, does this mean that I scored zero on all, and been penalised for working. Thank you

I assume you are talking about PIP here.
Normally, on the report, it gives a score against each question - so I cannot be certain, but if it is all marked with As, that does not sound particularly positive. You ask if you are penalised because you go to work. A lot of people who try to claim PIP feel the same way. It is possible to get PIP and work, but assessors will assume that if you hold down a job, you can carry out many of the criteria in the PIP assessment.

I don't know what you want to do next. If you disagree with the assessment report, you can write to the decision maker immediately to challenge the parts of the report you disagree with and point to the evidence that refutes what the assessor might say. You have a very small window of time to do this before the decision is made, and there is always a risk that the letter won't be processed on time or that it may have no impact on the final decision.
If you wait until you receive the decision letter and the outcome is not positive, you then have one month from the date on the decision letter to put in for a Mandatory Reconsideration. Again you need to challenge what the assessor has put in the report and point out why you think they were incorrect. We have guidance on how to put in for a Mandatory Reconsideration in the Guide to PIP Appeals.
Although the decision maker usually follows the views of the assessor, they do occasionally disagree, but you won't know whether that has happened until you get your decision letter.

Hi BIS, sorry yes its an assessment for pip, the assessor had plenty of evidence and letter from my GP but they never asked my specialists from the hospital who fully understand my rare condition and how it affects me, in the boxes under the descriptors where she has made a comment she says she had considered b, c or d, does that make a difference to the decision maker, thanks Leelo

I can't tell you what the decision maker will think. However, the decision make is not a medical professional, so that is why they often follow what the assessor has said.
The DWP rarely make contact with any medical professionals - and even though they understand how your rare condition impacts you, they are usually unable to say the impact on the specific PIP criteria. Claimants have to do that part and it can be quite a challenge.
