Yes, the tribunal was adjourned so they could get this information of the WCA from the DWP, they didn’t provide the results of that WCA.
I don’t know the exact reasons I was awarded the LCWRA because I never received a list of reasons as to why. I just received the usual acceptance letter which was what I uploaded to the usual upload evidence for the PIP appeal. I will have to look at this when I get a copy when the DWP release this.

As I cannot recall, if the numbers are different in the metres, I can walk, realistically they would decline me on the mobility part right because that’s an inconsistency? If it’s the same, maybe, but there would probably be an argument there, too, as I thought this is more to do with the mobility part, then the general daily living.

I do know that I have always made it clear in these assessments, even in the different places I’m claiming for. I always say that I can’t walk further than 20 m (as I get breathless, nausea, need to take a break), and I always used the analogy of a double-decker bus as that was the example I was given when I applied for a blue badge awhile back so I always used that example. Because if you get into the nitty-gritty of how far you can walk in metres it just becomes pointless and no one really thinks about how far they walk in terms of exact measurements. It would just be either low points or more than likely zero points just on the moving around part on the mobility category. If the measurements on the work capability assessment and the PIP assessment are different, Correct?

As long as you were consistent in your descriptions of your walking distance then I think this may not be the issue that the Judge seemed to think that it might be.

The WCA does not consider distances shorter than 50m, so the danger, for PIP, is not putting your real walking distance and just ticking the 50m box.

Until the paperwork becomes available, you will receive a copy before any re-listed hearing, I would park this issue as there is nothing that you can do about it.

So after what I wrote previously, I received the evidence which did work in my favour a little and had a tribunal date of the 4th of July today.

I just had my tribunal just about an hour ago and it lasted for about 90 minutes and just over.

AND I WON!

I was awarded enhanced for both parts.

Can’t believe it, although I’ll be honest I’m not terribly excited because maybe that’s just apathy sinking in a little bit since this fight is over but I don’t know it’s a weird feeling.

The tribunal panel in mine I will admit were okay. The doctor was very understanding so was the disability expert and the judge as well. I was honest enough to say that part of the issues has been with the system that hasn’t helped me during this. A member of the DWP was there to fight in their corner but I still answered questions and fought against her.

I want to thank this forum for the guides that it provided me to help create my mandatory reconsideration, previously I’d actually been turned away by a charity that was terrible and that’s the story for another day so thank you to the moderators and this forum. I generally appreciate your time and advice.

Now I’m not gonna do the usual keep fighting guys ,you deserve it, but I wanna make one point perfectly clear. I am a single guy that lives by himself and at every point during this fight even others I’ve done this solely by myself, no representation, no welfare officer, no family member or friends. I live alone and don’t have anyone. This isn’t designed to be a sob story, but realistically I am my motivator and demotivater and I could’ve given up at any time because I was the only person telling me to keep going, maybe if I had somebody else there to do so, maybe it would help me get out of those rough times.

But I got myself out of those rough times, so appreciate the support around you if you do because that’s always great and remember that some people don’t. If you don’t have anyone and you are alone in this fight and it feels hopeless and you feel that you are being gaslighted and that your symptoms aren’t correct, and the DWP is making you feel like your disability isn’t correct.

Screw em’.

Keep fighting for you because you’re the one that’s been fighting all this time along the battlefield, get to that goal because you owe it to yourself for how long you’ve been going in this. The destination is great, but it’s about that mental aptitude during that fight. I know it sounds like some weird war general but I just wanted to tell people who are lonely and are alone in this.

I know that it’s hard to find motivation when you are alone and you arguing that what you say is true, but to them you’re just a number and you’re just a name on a piece of paper. They are just doing their weird stuff that they do in an inconsistent system.

But forget about them believe that you can. You got this. 👊🏽

Was you successful for the depression and anxiety part of your claim?

Hey, it’s okay to ask!

Because it’s in regards to the questions that are asked about your condition, it’s more how depression and anxiety affects you in the questions. So for me, it’s being depressed and agoraphobic so I don’t mix with other people for example, anxiety in that as well and also planning a journey because you don’t have the capabilities to do that.

I also have a physical condition so that’s mixed in it as well, but depression can affect you in you not washing for example because you don’t change your clothes or fatigued from your condition that you don’t leave your bed. So think about the condition and how it relates to the questions in preparing food, going out, planning a journey, washing etc.

I hope your tribunal goes well for you and I understand the anxiety in the lead up to it! but stay strong, my friend!
