 	 				ESA Appeal was created by zoem			
  			 				Was on ESA (Support group) and after an assessment in May 2016 I was found fit for work. I went through the Mandatory reconsideration process with no change and had my court appeal today. I'm glad to say that the DWP decision was overturned. I didn't have to even wait for the decision, was told instantly.
 
I have mobility issues but it is mental health problems that I find stops me from being able to function. The WCA awarded me no points for this and after reading the full report of my assessment, which I received copies of in my court pack, there were numerous errors. Examinations were claimed to be done which weren't as well as the WCA not noting down the key issues I spoke about, totally disregarding the issues that would have given me enough points.
 
I did feel like not appealing as I found the process after the mandatory reconsideration was received impossible. DWP had totally backed the WCA. But with help from a close friend and the information on this site, I decided to appeal. I'm glad I did.
 
I have read many reports of key details and information being ignored in these meetings, maybe the DWP should insist these interviews are recorded, would save a lot of time, money and stress in the long run. All I can advise is always take someone along with you to the assessment.

Congratulations on the award.
 
It usually takes the DWP 5-8 weeks to process a Tribunal result, it would be worth your phoning them this week to make sure that they have received a copy of the Decision.
