Just to update this, I was last paid JSA £210.70 on 10 Dec 15, today 21 Dec 15 they just paid me £107.19. They said JSA would be closed on 15 Dec 15. No idea how they worked the figure out. Waiting game for ESA paying me now, and hopefully back pay.

I was on Incapacity Benefit £210.70 every 2 weeks, I then had ESA Assessment, found fit for work dated 15 July. Last payment was 3rd August, I appealed and went to Tribunal 16 Dec and Won, put in Support Group. Today I've received back pay from 4 August to 15 Dec. I thought I would be entitled to back pay to the date the decision was made 15 July. So am I still owed from 15 July to 4 August or do they only pay back money til last IB payment? I dont want to ring up incase I'm wrong.

abcd69,

I have merged your topics for continuity.

As the Tribunal re-looks at whether you should have qualified for ESA on the date of the fit for work decision, and have actually remade the fit for work decision, you should be entitled to any back payments from the date of the fit for work decision.

Remember, you can't receive JSA and ESA for the same period, so you should be paid any shortfall in the amount that you have been receiving in JSA, and what you would have received if placed into The SG originally, from the date of the fit for work decision.

Thanks for that, I just received a letter saying I've been paid £377.12 for 4 Aug til 15 Dec, and £107.09 for 16 Dec to 21 Dec. From 4 Jan I will be paid £250.10 every 2 weeks. Those payments are about right, but they have missed off payments from the decision date of 15 July, which I should be entitled to. So 15 July to 3rd Aug I'm £53.47 stilled owed.

From 3rd August I was on JSA plus premium £210.70 every 2 weeks, same amount I was paid on IB.

I'll wait til I'm paid again on 4 Jan, then give them a ring if I haven't been paid any extra.

Sometimes it seems like the DWP don't take kindly to losing and deliberately make it tough for people to get what they are legally entitled to!!!

Otherwise we might presume the DWP are in total disarray and incompetent!!!
