Life time DLA award

Life time DLA award was created by Lynsey
I was awarded a lifetime aard for dla based on the fact that my disability hasn't changed and is not likely to ever change. (high care and low mobility)

Do you think this is pertinent to my PIP claim? I mean is it worth mentioning as part of an argument that the problems I had last week when I was entitled to DLA for life fitted the descriptors (I believe) for PIP and that nothing has changed.

Their whole argument for me not getting PIP seems to be that they think I've lied throughout the form.

If anything I fit the planning and following a route better now becaus they've reworded the criteria slightly.

I'm afraid the PIP criteria are much more than "slightly" different from the DLA ones, it is perfectly possible that someone with a valid DLA award could legitimately fail to be awarded PIP.

I mean they've reworded the criteria for mobility differently and it's made a slight difference to the way it affects me.

Last time I went to get advice about DLA the woman in the advice place thought I'd grounds to appeal to ask for high mobility but she said it was risky because i might lose my award altogether so I diddn't bother.

I don't think its worth arguing on grounds of DLA entitlement as that is irrelevant to PIP claim.
If your DLA claim contains evidence that has been repeated at PIP then you could submit that paperwork which was accepted in your DLA claim and query why it is now being challenged as lies.
If the grounds for refusing PIP are purely that you've lied surely you have evidence to support your claim from your GP, consultant/specialist, carer(s), family, medical records etc etc
Are they accusing all of your evidence as being lies as well?

I think you're absolutely right about not mentioning the lifetime award.

I was a teenager when my mother went to a lawyer to apply for DLA initially and I was pretty oblivious. There was never any problems though. I remember someone coming out to the house and they spoke to me and my mum and said 'No problem, she'll get DLA dont worry' or words to that effect. But I dont have an old form from back then.

I am thinking about filling in the form I found online askign the DWp to supply me with all the information they have on me.

That's a very good idea saying why was it believed then but not now.

And yes, I have medical evidence. I hope it's enough. I have now got all my medical notes from GP which had gone missing. I haven't been able to look through them yet.

I have also been waiting on evidence from the brain injury project I attended from 2003 till about 2012 on and off. Because of a miscommunication they didn't forward my notes when I asked and it's a 40 day waiting time. They've said I'm a priority but I dont know that they'll send stuff in time. I contacted my old social worker but email bounced and the brain injury rehab unit i was in over a decade ago but no response.

I dont think there's any doubt that I can successfully challenge most of the comments the comments the HP and DM have made. I'm not worried that it'll turn out right in the end it's ust that it's causing me such a high amount of stress right now and I've had to give up my evening college class because I cant afford for a companion to take me anymore now that I've lost my DLA.

Oh well. It could be worse.

Your last couple of posts have concentrated on the quality of the assessment report, it's important to remember that over turning the report will not result in an award, this will only happen if you show that you meet the criteria so this should be where you focus your efforts first.
