Hello,

I will try and keep this as brief and to the point,

My friend recently claimed ESA and is in the support group, and will be able to claim her state pension next year, however, when she received her state pension forecast, the figures were less than she expected and her son contacted the Pension Services.

She has worked most of her life from the age of 20. However, she was ill in 1989/1990 and 1990/1991 and claimed IB. Pension Services sent her a statement they received from the Inland Revenue showing that whilst she was on IB from 1989/1990 she did not get any NI credits and the letter stated that if she disagreed she should contact the Social security office that dealt with her claim!!!!

Fortunately, her GP went through her medical records and gave her proof that sick notes were provided in 1989,however, she does not know what is the best way to deal with this and get her NI credits reinstated so she does not loose out on her state pension.

She will be grateful of any advise that you can offer, as her son phoned DWP, and as soon as 1989 was mentioned the person on the other end laughed and said its unlikely DWP will even consider looking into this, mind you this was someone from the call centre. They cannot go to the office that dealt with her claim as it's no longer there.

They are completely lost as the Inland Revenue were just as unhelpful.

As far as I am aware NI Credits should have been paid for every week that the claimant was receiving IB.

They need to write to the DWP explaining the problems and asking the DWP to confirm in writing that NI Credits should have been paid. Send it to the office that dealt with the ESA claim.
