Contributions Based ESA Questions was created by JediCP
Hi,
I have been in receipt of Contributions based ESA SG since November 2013. Before this I was on Incapacity.
I also receive DLA MRC and HRM.
Since 2012 I have been a full time student getting both a student loan and ESA and DLA.
For a long time now I have thought about the premiums for ESA. I do not get any Income based benefits or Income related ESA.
Okay, given that I got a student loan I presume I would not qualify for any Income based ESA. But what about in the summer holidays, in all the years I have been a full time student?
Is there anything that I could back date from the point I moved over to ESA?
Also when I was on Incapacity Benefit I did not get any Income Support, could I be due anything from this point?
I was on Incapacity Youth.
Thoughts?

I'm assuming that you are in the Support Group and therefore entitled to the Enhanced Disability Premium, you may also be eligible for the Severe Disability Premium, but this will depend on your living arrangement, do you live alone? and whether anybody receives Carers Allowance for you.
As I understand it your student loans are averaged across the academic year, not the calendar one, so in principle you would be entitled to ESA(IR) payments during the holidays and certainly the summer one, this assumes that you had no other form of income during these periods.
Whether you can backdate any claim will depend on whether you have the financial information available to support a claim, I would expect the DWP to put up a fight so you will need to be persistent and prepared for their questions.
I'm afraid we don't deal with IB so I can't say whether you have any entitlement to back payments, however, as a general comment, as you are no longer receiving the benefit and it has been more than 13 months since you were I would be surprised if they will entertain a claim even if entitled.
