PIP Asesssment BLACKBURN was created by suzie_p
I recently had my assessment in Blackburn and this whole experience and how the Assessor was towards me has set me back mentally. Closed questions, intimidating approach, telling me to hurry up, manipulating my answers I feel angry and cutting me off half way through explanations. I want these people to be accountable. I was awarded standard care and knocked back for all the rest which is unfair, despite evidence which was treated with contempt and ignored. I have to ask why I was treated like this. I have human rights and should be treated with respect I am sorry to say this did not happen in my case. I am sorry to be so negative but everyone needs to be aware of this.

Hi s_p,

Welcome to Benefits and Work :)

As it is "bad practice" to tag on to another members topic, and not really fair to them, I have given your post its own topic.

If you are unhappy with the way that The PIP Assessor treated you, or the way that they carried out your face to face consultation, you can complain to the relevant PIP Assessment Provider. (Their employer)

As you state that your PIP Consultation took place in Blackburn, I will assume that this was ATOS !

See further information : Here.

However, making a complaint in itself will not alter your PIP Awards !!

As a separate issue, if you wish to challenge your PIP Awards, you have one month from the date of the PIP Decision Notice letter to make a written request for a Mandatory Reconsideration (MR) of the PIP decision to DWP PIP.

You should be aware that if you do request an MR of your PIP awards, there is some risk involved, in that all of your existing PIP awards will be looked at afresh.

This could result in your current awards being reduced, or you losing them altogether.

If you are to consider requesting an MR, further information can be found from the links below :

PIP MR/Appeals Guidance.

Mandatory Reconsiderations Explained

&

Disability Rights UK Factsheet - Appeals and Mandatory Reconsiderations.

If you are to request an MR, even though it will help to challenge any recommendations made by the PIP Assessor in their report by pointing out discrepancies, it is more important to reiterate how and why you should have been awarded the relevant points under the applicable PIP Activities/Descriptors for a more appropriate PIP award.

Sending Documents to the DWP, ATOS, Capita or Maximus.

It may also help if you review our : PIP Claims Guide. (2nd Link on page)

If you still have any queries after reading through the above, please pose them by replying to this topic and we will try to help further.

In addition to Bro's excellent advice, you can also complain to the assessor's professional body (this would be the NMC for nurses, GMC for doctors etc). However. you do need to consider whether doing this would take more time and energy than you have to spare!

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Dear Suzie my son lives in Manchester and has faced the ordeal of an ATOS assessment and we are living through the repercussions of no award whatsoever at present..

The toll on the claimant and his or her family is incredible. If anyone thinks the UK is an easy touch for PIP thinks again.

suzie_p, I was so sorry to hear about your treatment at the assessment. I, too felt I was treated poorly when assessed by an Atos "professional" , I was so stressed by his attitude, my BP was recorded as 160/100, extremely high. I think you should complain about your treatment as the process of putting what happened into words definately helps and who knows, you may even get an apology.
