New ESA Claim - 3 Questions Please was created by Lynne B
I am about to apply for ESA and would like help on 3 questions please.
1. If I apply by telephone, is this instead of completing/sending a Claim form ie. do they take all details over phone and you then send Fit Note to them and await receipt of the ESA50 Questionnaire ?
2. I got the Fit Note yesterday for 2 months but bit concerned about Comments the doctor added to it (condition is Osteoporosis/Osteoarthris by the way). It wasn't my usual doctor; when I explained I needed to try for ESA for the moment, but hoped I could work again in the future, she added "Would like assessment for possible work that she is able to do in the future".
I was not happy that she included this as feel it may jeopardise my chance of getting ESA. (I am hoping to get in the WRAG, as know I won't qualify for Support Group. When I looked alarmed she said she put it because that's what I had said (so much for honesty being the best policy).
Chances of getting another note instead are remote I think until after the 2 months.
Will this go against me ?
3. Does the 13 week Assessment period count towards JSA entitlement if I am unsuccessful with ESA, ie would I only have 13 weeks left of JSA entitlement?

1. Yes, this should be the procedure, they'll tell you where to send the Fit Note.
2. The Fit Note should not be a problem, the important thing is that one has been issued, it should not matter if the doctor has added conditions.

If my recent ESA Application is unsuccessful, will I be able to claim JSA instead? Will the ESA application be an obstacle ? (I am limited but could consider work of some type).
Not wish to be negative but don't want payments to dry up after 13 weeks, without realising this may happen.

If you are found Fit for Work then you are by definition entitled to claim JSA, your attempting to claim ESA will have no effect.

Some additional information to your questions from yesterday and today, whilst ESA will not impact on your claiming JSA, if you claim JSA after the first Monday in 2016 then the Tax Years used for JSA(CB) will change to 2013-14 and 2014-15.
